Terms of Service
The short version
- Poweur is early (pre-1.0), free and provided as is. It works, but keep your own copies of anything important. We aren't liable for lost data or indirect losses.
- Your keys are yours. We can't recover them, so keep your recovery kit safe.
- Don't use the service for spam, abuse, impersonation or anything illegal. If you do, we can suspend your hosting.
- You own what you create. You can leave and take your data with you at any time.
1. The agreement
These terms are an agreement between you and the operator of Poweur named on the legal page ("we") for the hosted Poweur service: the relay and web app at poweur.net, IDs hosted under poweur.net, and the sign-in bridge at oauth.poweur.org. By creating or using a hosted ID you accept these terms and our Privacy Policy.
The Poweur software is open source, under the licenses in its repository. Those licenses, not these terms, cover the code. If you run your own relay, these terms don't apply to it.
2. An early service
Poweur is pre-1.0. Features, formats and limits may change, and things can break. We work hard not to lose data, but keep your own copies of anything important. You can download everything at any time. We may change or stop parts of the service. If we plan to shut down the hosted service, we'll give at least 60 days' notice so you can export your data or move your ID.
3. Your ID and your keys
- You must be at least 16, or have a parent's or guardian's permission.
- Your private keys live on your devices. We can't reset or recover them. If you lose every device and your recovery kit, you lose access to your ID. Keep the kit somewhere safe.
- You're responsible for what's done with your ID and keys, including by agents or apps you grant access to.
- Hosted names are first come, first served, within our name rules (length, reserved words, blocked terms). We may refuse or take back a name that impersonates a person or organisation, infringes a trademark, misleads, or breaks these terms.
4. Acceptable use
You may not use the service to:
- break the law, or store or send anything illegal, including child sexual abuse material, which we report to the authorities;
- send spam or unsolicited bulk messages, or create IDs in bulk or automatically to get around limits or anti-spam rules;
- impersonate someone, or phish for credentials, keys, payments or recovery kits;
- harass, threaten or dox anyone, or incite violence;
- distribute malware, or host content meant to attack other systems;
- infringe anyone's copyright, trademark or privacy;
- overload, probe or attack the relay, the bridge or other relays, or get around rate limits, quotas or security measures;
- resell or rebrand the hosted service as your own without our agreement. Running your own relay is always fine.
Agents and bots are welcome, provided the ID says who operates them and they follow these rules.
5. Storage and usage limits
Hosted IDs come with limits on storage, file size, message rates and other resources, which we set and may change. If you run into a limit, the app tells you and says who to message to ask for more. Tell us what you need it for. Paid plans with more room may come later. They will never be required to keep your ID, recover it, message your contacts, sign in, or export your data.
6. Your content
You keep all rights to what you create and upload. You give us only the permission we need to run the service: storing, copying, transmitting and displaying your content to the people you share it with, for as long as it's on the service. What you make public (your ID document, profile, public folder and public links) can be seen and copied by anyone.
We can't read end-to-end encrypted messages. We don't monitor files, but we may act on reports and on content that is public or that we become aware of.
7. Enforcement
If you break these terms, we may remove content, limit features, or suspend or end the hosting of your ID. Where we reasonably can, we'll tell you why and give you a chance to respond and to export your data first. We may act without notice for serious abuse, legal requirements or threats to the service.
Suspension ends our hosting. It doesn't delete keys you hold. Report abuse to [email protected] or message support.poweur.net.
8. Other apps and relays
Apps you sign in to with your ID, and relays run by others that you exchange messages or files with, are not ours. Their own terms apply. We're not responsible for them.
9. Leaving
You can stop using the service at any time. You can export your data, move your ID, or delete it (see the Privacy Policy).
10. No warranty
The service is free, experimental and provided "as is" and "as available". To the fullest extent the law allows, we give no warranties or guarantees, express or implied: not of availability, uptime, speed, security, accuracy, fitness for a particular purpose, or that data will be kept, delivered or recoverable. You are responsible for keeping your own backups and your recovery kit.
11. Limitation of liability
To the fullest extent the law allows:
- we are not liable for any indirect, incidental, special, consequential or punitive loss, or for loss of data, files, messages, keys, access to your ID, profits, revenue, business, goodwill or opportunity, however caused;
- we are not liable for content, messages or files from other users, for relays, apps or services run by others (including apps you sign in to with your ID), or for events outside our reasonable control, such as outages of our providers, attacks, or changes in law;
- our total liability for all claims connected with the service is limited to the greater of the amount you paid us in the 12 months before the claim and €50.
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud, for damage caused intentionally or by gross negligence, or any other liability that cannot be limited or excluded by law, including rights you have as a consumer that cannot be waived.
12. Your responsibility for misuse
If you use the service in breach of these terms or the law (for example by sending spam, uploading infringing or illegal content, or attacking other systems), you are responsible for the resulting claims, and you agree to compensate us for reasonable costs, including legal costs, that we incur because of them, to the extent the law allows.
13. Law and disputes
These terms are governed by Portuguese law, and disputes go to the competent courts of Portugal. If you're a consumer, you keep the protection of the mandatory laws of the country where you live, and you can bring a claim there. 14. Changes
We may update these terms. For changes that matter, we'll give notice on poweur.org and in the app at least 30 days before they take effect. If you keep using the service after that, the new terms apply. If you don't agree, you can export your data and leave. The change history is public.
15. General
If any part of these terms turns out to be unenforceable, the rest still applies, and the unenforceable part applies to the fullest extent the law allows. If we don't enforce a term straight away, we haven't waived it.
